ohms.marketing is a digital marketing service operated by O.MS.H Media Inc., a company incorporated in Ontario, Canada. When you hire ohms.marketing, you're working with Omar and the O.MS.H Media Inc. team based in Toronto, Ontario.

By engaging our services or using this website, you agree to these terms.

what we do

We offer the following digital marketing services:

  • Google Ads management — campaign setup, ongoing optimization, and reporting for search, display, and other Google Ads formats
  • Website design and development — custom websites built for performance and conversions
  • Email marketing — list management, campaign design, and automation setup

The exact scope of work for your project will be agreed upon before we start. If something isn't explicitly included in your plan, it's not included, but just ask and we'll figure it out.

payment

Payments are processed securely through Stripe via payment links sent to your email. We currently accept major credit and debit cards.

  • Monthly retainer services are billed at the start of each billing cycle.
  • Project-based work (like websites) may require a deposit before work begins, with the remainder due on completion.
  • Invoices are due on receipt unless otherwise agreed in writing.
  • We reserve the right to pause or discontinue services if payment is overdue by more than 14 days.

All prices are in Canadian dollars (CAD) unless stated otherwise.

We stand behind our work. If you're not satisfied within the first 30 days of service, let us know and we'll issue a full refund, no questions asked.

This applies to new service engagements. It does not apply to ad spend (that goes directly to Google or other platforms and is outside our control), or to services already fully delivered (e.g., a completed website that has been handed off).

no long-term contracts

Our ongoing services are month-to-month. You can cancel at any time with reasonable notice (we ask for at least 7 days before your next billing date so we can wrap things up properly). There are no cancellation fees.

We'd love it if you told us why you're leaving, it helps us improve, but you're under no obligation to explain.

intellectual property

Here's how ownership works:

  • Your website: Once your website is paid for in full, it's yours. You own the design, the copy (if we wrote it for you), and the code we built for your project. We'll transfer all relevant files and access to you.
  • Our tools and processes: The internal systems, templates, frameworks, and processes we use to build and run campaigns are ours. They're how we work efficiently, and we retain ownership of those even after your project is complete.
  • Your content: Any content, logos, images, or materials you provide to us remain yours. We'll only use them to deliver your services.
  • Third-party assets: If your project uses stock photos, fonts, or other licensed assets, those are subject to their respective licenses.

your responsibilities

To do our best work, we need your help:

  • Provide accurate business information and any materials we request in a timely manner.
  • Give us access to the platforms we need (Google Ads account, domain registrar, hosting, etc.).
  • Review and provide feedback on deliverables within a reasonable timeframe. Delayed feedback may push back timelines.
  • Make sure you have the legal rights to use any content you give us (photos, logos, copy, etc.).

results and expectations

We work hard to deliver real results, but we can't guarantee specific outcomes. Digital marketing performance depends on many factors outside our control: competition, market conditions, your product, your budget, platform algorithm changes, and more.

What we do guarantee: honest communication, transparency about what's working, and a genuine effort to grow your business.

limitation of liability

To the maximum extent permitted by law, O.MS.H Media Inc.'s liability to you for any claim arising from our services is limited to the amount you've paid us in the 30 days prior to the claim.

We are not liable for indirect, incidental, or consequential damages, including lost revenue, lost data, or business interruption, even if we've been advised of the possibility of such damages.

We are also not responsible for changes made by third-party platforms (like Google changing its ad policies or algorithms) that affect your campaign performance.

live streaming

O.MS.H Media Inc. personnel may live stream their work on client projects. During these streams, no sensitive personal or financial information of the customer will be disclosed. Customers may opt out of having their project featured in live streams by submitting a request via email at [email protected] or by phone. We will honor such requests promptly and without question.

confidentiality

We treat your business information as confidential and won't share it with outside parties except where necessary to deliver your services (e.g., granting a contractor access to your project). We expect the same from you regarding any proprietary processes or tools we share with you.

changes to these terms

We may update these terms from time to time. If we make significant changes, we'll let you know by email. Continued use of our services after changes take effect means you accept the new terms.

governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes will be resolved in the courts of Ontario.
